Read “A Moratorium on the Presentation of DNA Evidence” from the University Library

 

The author of this article stated that “this paper attempts to address wrongful convictions by calling for a temporary moratorium on the presentation of DNA evidence at trial, implemented until federal standards are put in place to regulate the presentation of DNA evidence…DNA analysis schemes are dangerously flawed…current problems in DNA testing procedures.” The author claims this is true by presenting several examples and arguments throughout this article.  

 

This Daubert Standard requires that expert testimony regarding DNA evidence must be based upon a methodology that is scientifically valid and extremely reliable, peer reviewed, and universally accepted by the scientific community, and published in professional publications. The error rate and confidence levels for the DNA analysis methodology must also be known and stated. 

  • What is your analysis of this author’s demand for a temporary moratorium regarding DNA evidence after considering established court case law, Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579 (1993), which was upheld by the United States Supreme Court?
  • Do you think that the author has scientific proof based upon peer-reviewed and accepted scientific methods that document his claims? Why or why not?

As a criminal investigator in a police department, imagine that you are investigating a series of crimes that appear to be committed by the same person. You have been asked to consult on the creation of a criminal profile of the unknown suspect. You will need to research and analyze what is needed for the criminal profile and provide this information to the task force investigating the case.  

 

 

  1. Find your own criminal profile to use. Keep in mind that it can be a local criminal profile and it does not have to be a serial murderer. Focus on finding a profile of a criminal that appears to be committing a series of crimes.
